Observatory /Terms of Use
Effective November 3, 2026. Mothlight is operated by SEW Inc. (SEWORKS). Questions: help@mothlight.ai.
These Terms of Use ("Terms") govern your use of mothlight.ai, the Mothlight API, the MCP endpoint and related data (the "Services"), operated by SEW Inc., doing business as SEWORKS ("SEW", "we", "us"). By using the Services you agree to these Terms. If you use the Services for an organization, you confirm you are authorized to bind it, and "you" includes that organization. You must be at least 18 years old.
1. The Services
Mothlight publishes intelligence about bots and AI agents observed by passive sensors. The public site and public API provide aggregates, top lists, a sampled feed and methodology. Approved API keys provide additional data under plans described on the Access page. We may change, suspend or discontinue any part of the Services.
2. Accounts, API keys and plans
- Accounts. You sign in with a one-time link sent to your email address (or, where offered, a Google or Microsoft account); we do not use passwords. Every account belongs to an organization. The person who creates an organization is its owner and may invite members and assign roles; owners and admins are responsible for their members' use of the Services and for keeping membership current. We may refuse disposable email addresses.
- Keys. Owners and admins can create API keys for their organization. A key is shown once and must be kept confidential; you are responsible for activity under your organization's keys. Tell us promptly at help@mothlight.ai if a key is exposed; we may rotate or revoke it. Keys created before accounts existed remain valid under the plan they were issued with.
- Plans. Each organization has a plan (Public, Researcher, Professional or Enterprise) that sets the scopes, rate limits, quotas, history and delay of its keys. A request parameter never expands a key's scope. We meter usage per key. Public and Researcher are free; Researcher requires our approval. Professional is a paid subscription purchased online (Section 3). Enterprise is provided under an order form or separate agreement, which prevails over these Terms where they conflict.
- We may suspend or revoke an account or key, with or without notice, for a breach of these Terms, a security risk, unpaid fees, or misuse.
3. Fees, automatic renewal and cancellation
- Prices. Professional prices are shown on our site and at checkout in US dollars and include any sales tax we are required to collect. Customers outside the United States are responsible for any VAT, GST or similar taxes that apply to their purchase, for example under a reverse-charge mechanism.
- Founding offer. The first 50 organizations to subscribe to Professional pay the founding price: US$199 per month for the first 12 months, or US$1,990 for the first annual term. After that the subscription renews at the then-current list price (currently US$299 per month or US$2,990 per year). One founding offer per organization; we may end the offer for new subscriptions at any time.
- Automatic renewal. A subscription renews automatically at the end of each monthly or annual term until you cancel, and you authorize us, through our payment processor Stripe, to charge your payment method for each renewal at the price then in effect. Before you subscribe we show the price, the term and these renewal terms, and you agree to them at checkout. We notify you at least 7 days and no more than 30 days before a price increase takes effect, and for annual plans we send a reminder at least 15 days before each renewal.
- Cancellation. You can cancel online at any time from the billing page of your account. Cancellation stops future renewals; paid features continue until the end of the current term.
- Refunds. Monthly payments are non-refundable. If you ask within 14 days of your first annual payment, we refund that payment in full and end the subscription; annual renewals and later requests are non-refundable. Nothing in this section limits refunds required by law. To ask for a refund, write to help@mothlight.ai from an organization owner's address.
- Failed payments. If a renewal payment fails, paid features continue for up to 7 days after the term ends while payment is retried; after that your organization returns to its free plan until payment succeeds.
- Changes. We may change prices or plan features for future terms with advance notice. A change never affects a term you have already paid for.
- There is no free trial of Professional; the free plans let you evaluate the data first.
4. Content and data rights
- Ownership. The Services, the site content, the labelled dataset and all non-public data are owned by SEW and its licensors and are protected by law. Except as stated below, no rights are granted.
- Aggregates and charts. You may quote and cite aggregate figures and charts from the public site with attribution to Mothlight (source URL, UTC observation window and access date). This is a permission to cite, not a CC BY license.
- Public sample dataset. The public sample dataset (the 1-in-100 sampled observations published as the public sample) is licensed under Creative Commons Attribution 4.0 (CC BY 4.0, https://creativecommons.org/licenses/by/4.0/). CC BY 4.0 applies to that dataset only.
- Licensed data. Data available through a paid plan (event-level data, streams, exports and any raw data) is licensed to you on a limited, non-exclusive, non-transferable, revocable basis for your internal security, research or defensive operations during your plan. Unless a written agreement says otherwise, you may not redistribute, resell, sublicense, publish, or use it to train or evaluate machine-learning models offered to third parties, and you must keep watermark and provenance markers intact.
- Third-party sources. Some data comes from public sources (for example NIST NVD, CISA KEV, FIRST EPSS, CVE.org records and IPtoASN) and remains subject to their terms and attributions.
5. Acceptable use
You will not, and will not help others to:
- use the Services or data to attack, scan, probe, contact, retaliate against, harass or identify the operators of any observed system or person;
- attempt to locate, fingerprint, publish or interfere with our sensors or the systems they expose;
- access data or scopes you are not entitled to, circumvent rate limits, quotas or technical controls, or scrape the site beyond the published API limits;
- re-identify individuals from de-identified or aggregated data;
- use the data as a factor in decisions about an individual's eligibility for credit, employment, insurance, housing or similar purposes, or in any way that would make us a consumer reporting agency;
- execute, fetch or deploy captured payloads, or use them to build malware;
- misrepresent withheld cells as zero, sampled data as complete measurements, or labels as proof of intent or attribution;
- violate any law, including privacy, computer-misuse, export-control and sanctions laws; or use the Services from or for a sanctioned country or person.
6. Accuracy and reliance
Labels, confidence scores, AI-likelihood estimates and attributions are probabilistic measurements with stated uncertainty, denominators, delays and publication thresholds. They can be incomplete or wrong. You are responsible for your own decisions, including any blocking or enforcement, and for verifying data before relying on it.
7. Disclaimers
THE SERVICES AND ALL DATA ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
8. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SEW WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, AND SEW'S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF US$100 OR THE AMOUNTS YOU PAID US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE CLAIM.
9. Indemnity
You will defend and indemnify SEW against third-party claims arising from your use of the Services or data in breach of these Terms or applicable law.
10. Termination
You may stop using the Services at any time. We may suspend or terminate your access if you breach these Terms. You can delete your account or organization at any time; deleting an organization cancels its renewals but does not refund the current term unless the refund policy says otherwise. Sections 4.1, 4.4 (for data already received, which you must delete on termination unless your agreement says otherwise), 5 through 11 survive termination.
11. General
- Governing law and venue: California law, excluding its conflict-of-laws rules; exclusive jurisdiction of the state and federal courts in San Francisco County, California.
- Changes: we may update these Terms by posting a new version with a new effective date; material changes will be noted on the changelog. Continued use after the effective date means you accept the update.
- Privacy: our Privacy Policy describes how we handle personal information.
- Entire agreement and precedence: these Terms, any order form and any separate written agreement are the entire agreement; a signed agreement prevails where it conflicts.
- Assignment, severability, no waiver: you may not assign these Terms without our consent; an unenforceable provision does not affect the rest; failure to enforce is not a waiver.
- Notices: legal notices to SEW Inc., 200 Continental Dr Ste 401, Newark, DE 19713-4337, USA, with a copy to help@mothlight.ai.
